What is the saliva drug test?

The drogotest is a saliva test that detects the presence of psychotropic substances, including cannabis(THC), amphetamines, cocaine, methamphetamine, opiates and benzodiazepines. This traffic control for drugs was implemented in Spain in 2007, and its use has been extended to companies and other areas.

What does the Drogotest measure?

  • Qualitative Detection: Indicates the presence of drugs(positive or negative, no matter the quantity).
  • Substances: THC (cannabis), amphetamines, benzodiazepines, cocaine, MDMA, methamphetamine and opiates. The list of substances detected may vary depending on the test model and manufacturer.
  • Detection Threshold: Identifies substances that exceed between 10 and 20 nanograms per milliliter of saliva (cut-off point).

How the Saliva Drug Test Works

The drogotest is a rapid screening device that analyzes a saliva sample to identify psychoactive substances. The procedure is as follows:

  1. Collection: An absorbent strip rubbed on the tongue is used to collect a sufficient sample of saliva.
  2. Device Application: The moistened strip is inserted into the plastic test cartridge, ready to initiate a specific chemical reaction.
  3. Processing and Activation: The device displays a control line indicating that the test has worked correctly. The appearance of additional lines indicates the presence of one or more substances; only if only the control line is displayed is it considered negative.

Note: The test does not indicate the exact moment of consumption and may be positive days after the effects have worn off.

Saliva Test Results

What is the allowed rate of drugs in driving?

In terms of driving, the regulations establish a zero tolerance for the presence of drugs in the body. The result of a saliva test is positive or negative, regardless of the amount. It is considered negative when it is below the established detection threshold, which is very low, and any amount exceeding this threshold is punishable.

What happens if the saliva test is positive?

Upon obtaining a positive result in the drogotest, the police will take an additional saliva sample in sufficient quantity to perform another laboratory analysis, ensuring the chain of custody. The driver has the right to request, in accordance with article 14.5, a contrast test, which will generally be a blood test, to confirm or refute the initial result. These tests must be carried out in health centers under the custody of the agents in order to be legally valid.

Is it possible to claim a false positive on the drogotest?

You have the right to present allegations within 20 calendar days from the notification of the initiation of the sanctioning procedure; but doing so implies waiving the benefit of the reduced payment of 50%.

Can I have a false positive saliva test?

Yes, the drogotest can yield false positives, i.e. detect traces of penalized substances even when the drug has not been consumed, due to factors such as interference from certain medications or individual variables (age, sex, hydration, etc.). At the time of the fine, the police themselves will collect an additional saliva sample to be compared with a subsequent laboratory analysis. If this is negative, the fine will be withdrawn.

How to make a contrast request?

If you consider that the result of the drogotest is wrong, you must formally request the contrast test, which involves going to the nearest medical center to perform a more accurate analysis (usually blood sample), guarded by the police. This request is based on the right of the interested party, as established in article 14.5, and its result must be sent by the doctors to the competent authority for evaluation.

Can I refuse to take the saliva test?

No. Article 14.2 of the Traffic Law obliges drivers (and those involved in accidents or violations) to submit to alcohol and drug tests. Refusal to take the test carries the same penalties as a positive result (a fine of 1,000 € and loss of 6 points on the license), plus additional liabilities arising from disobedience.

What happens if I pay the fine and then the laboratory confirms a negative result?

If the driver pays the fine and then the laboratory analysis shows a negative result for drugs, the administration will proceed to reimburse the amount paid, without any additional consequences or maintenance of the sanction.

Can smoking CBD test positive for THC?

CBD products may contain traces of THC that could test positive. Even if they contain less than 0.2% THC, the consumption of these products or smoking CBD can result in a positive saliva test because, as explained, the test only measures the presence of THC, regardless of the amount. Can I know if I will test positive for THC?

Drogotests are available in pharmacies and even on Amazon. However, it should be considered that the sensitivity and detection threshold may vary between different tests, so a negative result in a pharmacy test does not guarantee 100% that the same result will be obtained in an official drogotest.

How long do I have to go without using to test negative?

In occasional users, various reports indicate that THC is detectable within 24 to 48 hours after consumption, but in people who smoke marijuana regularly, the accumulation of the substance and its metabolites in the tissues, as well as various individual factors, can extend detectability to several days or even weeks.

Is it advisable to appeal a fine for a positive drug test?

Appealing the fine prolongs the process and implies waiving the 50% reduced payment. In general, the only way to win the appeal is to prove a negative test result, regardless of arguments such as being a CBD or THC user. If there is no negative test, an appeal is usually discouraged. If there is strong evidence to prove the absence of drugs in the body or if there are strong arguments questioning the validity of the test, an appeal could be filed.

Can I be forced to take a drug test at work?

In the workplace, drug testing is not generally mandatory, except in sectors where safety regulations require it, such as transportation, aviation or construction. A company may include these tests in its internal policy, but their application must respect the privacy and rights of the employee. Except in regulated cases, the employee is not obliged to submit to the test without his or her consent, and refusal cannot imply sanctions without legal justification. If a test is requested without a clear legal basis, it is recommended to seek advice from a lawyer specialized in labor law.

Sanctions

  • Fine: 1,000 euros. You have 20 days from the notification of the fine to pay with 50% reduction (500 €).
  • Loss of points: Up to 6 points on the license.
  • The same sanction applies if one or more substances are detected.

Penalties for testing positive in the traffic saliva test are established in Royal Legislative Decree 6/2015 and are considered a very serious offense.

The presence of drugs in the body is sanctioned, not the fact of being under the effects. This means that even occasional users can test positive, even if the effects have worn off.

Those substances or medicines with medical prescription are excluded. It should be noted that, in Spain, the use of medical cannabis is not recognized as a reason for medical prescription, so its consumption is not exempt from penalties either.

In addition to the administrative sanction, if it is evidenced that the ability to drive is impaired -for example, through symptoms such as nervousness, pupil dilation or loss of balance- the case may lead to criminal prosecution.

Procedures and Resources

  • Contrast test: If you are sure that you have not consumed, request a blood or urine test at the same time as the saliva test. An analysis or test that has been performed without the custody of the police will be disregarded.
  • Judicial remedies: Once the administrative procedure is concluded, the only means of appeal is the Contentious-Administrative Court. Such appeal will be viable only if reliable evidence is presented to demonstrate the absence of drugs in the organism. In the absence of duly certified evidence, it is not advisable to file an appeal.

Prescription and Expiration of the Sanction

  • Statute of limitations: Six months for serious and very serious infringements.
  • Expiry: If the sanction is not resolved within one year, the procedure expires and is filed.
